Welcome to ThinkSync!
While your use of our Services, which includes the Platform that you are about to enter,
is governed by the Agreement that your School District has signed with us, we are
providing these terms to you so that you understand how our Services operate. If you
do not agree with these terms or conditions, please do not use our Platform or
Services.


THINKSYNC DOES NOT PROVIDE MEDICAL ADVICE, MEDICAL CARE, OR MENTAL
HEALTH SERVICES OF ANY KIND.

ThinkSync offers information, suggestions, and prompts for anyone choosing to seek selfgrowth, self-love, and self-care. ThinkSync does NOT provide, and is NOT a substitute for,
professional medical or mental health counseling, therapy, crisis, consulting, diagnosis,
or treatment. For diagnosis of, treatment of, or advice about a mental health issue, you
should consult a licensed mental health professional.
If you are feeling suicidal, thinking about hurting yourself, or are concerned that someone
you know may be in danger of hurting himself, herself, or others, please call the National
Suicide Prevention Lifeline at 988 or 1-800-273-TALK (8255), or the Suicide Hotline at 1-

  1. Our Services
    1.1. Our Services are a tool that may help Users manage their own general emotional wellbeing. ThinkSync does not provide, nor hold itself out to be, a substitute for
    professional medical assessment, advice, diagnosis, or treatment provided by or
    received from, a psychiatrist, psychologist, therapist, counselor, mental health
    practitioner, or any other licensed or registered health care professional. ThinkSync
    is not a substitute for diagnosis or treatment by a mental health professional;
    neither ThinkSync, nor any of its employees, contractors, or agents, diagnose
    or treat mental health disorders as defined in the Diagnostic and Statistical
    Manual, Fifth Edition (DSM-V-TR), or any subsequent edition or publication by
    the American Psychiatric Association.
    The resources available through ThinkSync
    and its Services should not be construed as formal or clinical advice, nor the formation
    of a psychologist-client, physician-patient, or therapist-client relationship.
  2. Acceptance
    2.1. By continuing to use our Services, you agree to these terms.
  3. Access
    3.1. You access our Services through your ThinkSync profile, and the type of profile
    that you create will depend on your role with the School. If you are a student
    user, your profile may have been created for you and populated with
    information provided by the School.
    3.2. If you lose your password or login credentials, or if they become compromised,
    please notify us or the School immediately.
  4. Use and Misuse
    4.1. While you use our Services, please only provide truthful information. Though
    you are never required to share more than you are comfortable with, our
    Services perform best when accurate, truthful, and complete information is
    provided.
    4.2. If you are provided any policies or guidelines regarding our Services, please
    follow them.
    4.3. Misuse of our Services is not permitted. You may not interfere with our
    Services or try to access them using any method other than what you have
    been provided by us or by the School. Specifically, you may not:
    4.3.1. Use the Services in an unlawful manner or for any unlawful purpose;
    4.3.2. Transmit any viruses, worms, malware, or anything similar, within the
    Services;
    4.3.3. Post or link to any offensive materials;
    4.3.4. Use the Services or Platform to violate the rights of any person or to
    otherwise bully or harass any person;
    4.3.5. Use the Services for any commercial purpose;
    4.3.6. Obtain or try to obtain information from or about the Services or the
    Platform beyond what is made available to you.
    4.4. While we reserve the right to monitor any content submitted or any content
    within our Platform, we are not obligated to do so.
    4.5. Any misuse of our Services may lead to your account being disabled and
    referred to the School or proper authorities.
    4.6. Your use of our Services does not give you ownership of any intellectual
    property found within the Services or the Platform itself. How we use the
    information that you provide to us is outlined below and detailed in our Privacy
    Notice.
  5. Content
    5.1. The products and features within the Platform and offered through our Services
    are ours. The data that you provide to us, however, may be owned either by
    you or by the School. You and the School extend to us a license to use that
    data for purposes of carrying out the Agreement between the School and us.
    To the extent that we aggregate certain data, such aggregated data is owned
    by us.
  6. Your Data
    6.1. Our Privacy Policy explains how we handle your personal data and protect your
    privacy when you use our service. By using our Services, you agree that we
    can use such data in accordance with our privacy policies.
    6.2. For student users, we recognize that certain data may be governed by
    applicable state and federal laws. We acknowledge as much and our use of
    student data is limited accordingly.
  7. General
    7.1. We provide our Services using a commercially reasonable level of skill and
    care and we hope that you will enjoy using them. But there are certain things
    that we don’t promise about our Services. These are outlined more fully in the
    Agreement between us and the School, but they center on the fact that
    Services and Content provided on our platform, including all mental well-being
    analytics and insights, are intended for informational and educational purposes
    only. They are not intended to be, and should not be interpreted as,
    professional medical or psychological advice, diagnosis, or treatment. YOUR
    USE OF THE SERVICES, THE CONTENT AND PLATFORM IS AT YOUR
    SOLE RISK.
    7.2. We will use commercially reasonable efforts to ensure that our Services are
    available to you 24 hours a day, 7 days a week, excluding planned downtime
    and any events outside of our control.
    7.3. As stated above and elsewhere, we are not responsible for providing
    emergency services or interventions, and our liability is limited to the provision
    of general wellness analytics to the School.
    7.4. If, at any point, you wish to stop using these Services or our Platform, you may
    do so.
